Memorandum of Understanding

For Checking Out Equipment

This agreement is between Idaho Virtual Reality Council, Inc. (“IVRC, we, or our”) and you and/or your organization as outlined in the signature page.  

You hereby agree:

1) That you will follow all instructions communicated to you to the best of your ability.

2) We would appreciate if you remember that the items you are checking out are EXPENSIVE and SENSITIVE to damage

3) While we do not plan on charging people for most harms that comes to the equipment, you agree that you will be responsible for any damage, loss, or theft of the equipment while in your care if we, in our sole discretion, determine you have mistreated or mismanaged the equipment. You will be provided an invoice for repair or replacement costs that must be paid within 60 days. You agree to release and waive your right to any defenses, damages, or attorney fees for any legal claim brought in connection therewith.

4) While utilizing our equipment, you will not claim to be operating on behalf of IVRC and will take whatever actions are necessary to clear up any mistaken belief that you are. Any liabilities from your operation of our equipment are yours alone. You agree to indemnify and hold harmless IVRC from any liabilities due to your operations and our equipment while under your care.

We carry general liability insurance for our business and equipment, however, YOU are the one we trust the most though to make sure that nothing happens while you are out and about with our equipment.
